Terms of Service & Privacy Agreement

1. Acceptance and Scope

By accessing the website at Dubzy.website or using the F2FM Club mobile application (the "Service"), you agree to these Terms. This Service is operated by Thomas Wall ("The Dubzy") in partnership with Farm 2 Family Meats LTD.

2. User Accounts & Data Rights (GDPR Compliant)

  • Authentication: We use Firebase (Google and Apple Sign-In). We do not store or manage your passwords.
  • Data Collection: We collect your Full Name, Email, and Phone Number.
  • Data Portability: You have the right to download all data we store about you. This feature is available in the app settings and provides a machine-readable file of your identity and transaction history.
  • Right to Erasure: You may delete your account at any time. This permanently wipes your PII, Stars, and history from our active database.

3. F2FM Club Loyalty Rules

  • The Process: Stars are awarded by scanning your in-app QR code at the truck.
  • Star Calculation:
    • Base Rate: Every £25.00 spent earns 0.5 Stars.
    • The Bonus: If your spend exceeds the threshold by more than 25% (£6.25+), an additional 0.25 Stars is awarded (e.g., a £31.25 spend earns 0.75 Stars).
    • The Cap: Total earnings are strictly capped at 5.0 Stars per single transaction.
  • Minimum Spend: A minimum spend of £5.00 is required for any transaction to be recorded in the Service.
  • Finality: Spend amounts are entered manually. You must verify the amount at the time of scanning. Once finalized at the truck, Star allocations are considered final.
  • Refunds: If a transaction is refunded, any Stars earned from that transaction will be automatically deducted from your account balance.

4. Redemptions & Offers

  • No Cash Value: Stars are promotional markers with no monetary value (£0.00). They cannot be exchanged for cash, sold, or transferred.
  • One-Time Use: Unless stated otherwise, individual rewards and offers are limited to one redemption per customer.
  • Modifications: We reserve the right to change Star values or reward costs with 30 days' notice via push notification or in-app alert.

5. Pre-Orders & Perishables (Hampers)

  • Reservations: The Service allows for the reservation of meat hampers.
  • Perishables: Per UK Consumer Contracts Regulations, raw meat and bespoke food hampers are exempt from "cooling-off" periods. Once prepared for your specific collection date, orders are non-refundable and cannot be cancelled.
  • Missed Collections: Items not collected during the agreed window will be forfeited to ensure food safety; no refunds will be issued.

6. Technical Security & Personal Server

  • Hosting: We host our own backend using a secure PostgreSQL database on a private server.
  • Encryption: All Personally Identifiable Information (PII) is protected via database-level encryption.
  • Push Notifications: We use FCM tokens for account alerts. You may opt-out in your device settings.

7. Intellectual Property & Acceptable Use

  • Ownership: All code, custom backend logic, and design assets are the intellectual property of Thomas Wall.
  • Restrictions: You may not attempt to reverse-engineer the Service, use automated scripts to "farm" Stars, or interfere with server operations.

8. Liability & HMRC Compliance

  • "As Is" Service: We are not liable for Star loss due to server downtime or hardware failure.
  • Accounting: Our official business records are maintained physically. App data is a promotional supplement. We retain anonymised transaction totals for HMRC compliance and internal tax reporting.
  • Governing Law: These terms are governed by the laws of England and Wales.

8.1 Limitation of Liability

To the maximum extent permitted by law, Thomas Wall ("The Dubzy") and Farm 2 Family Meats LTD shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising out of your use of the Service. Our total liability for any claim arising from these terms shall not exceed the total amount you paid to us (if any) in the 12 months prior to the claim.

Note: This does not affect your statutory rights as a consumer regarding faulty goods or personal injury caused by negligence.

8.2 Indemnification

You agree to indemnify and hold Thomas Wall and Farm 2 Family Meats LTD harmless from any claims, losses, or legal fees resulting from your violation of these Terms or your misuse of the Service (including attempts to circumvent the Star calculation logic).

8.3 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
